Victoria’s Long Service Leave Act 2018:
- may not apply to employees who are covered by a federal award or workplace agreement – individual or collective – where that award or agreement contains its own long service leave provisions.
- does not apply to employees who have their long service entitlement provided by another act or regulation – such as workers in building and construction, where it’s provided by the CoINVEST scheme.
Before making a report, contact the Fair Work Ombudsman to determine whether an award or agreement applies instead of the Long Service Leave Act 2018.
Workforce Inspectorate Victoria (WIV) investigates reports about businesses withholding long service leave and answer general enquiries about long service leave.
WIV is not a wage recovery body, however your employer may pay your entitlement as a result of our investigation.

Report a business you suspect of breaking long service leave rules
To report a business using our online form, you will need to answer questions about yourself, your employment and the employer – this is important information that helps us assess your report.
Before starting your report, make sure you have this information ready:
About your employment
- which award, enterprise agreement or individual agreement you were covered by – the Fair Work Ombudsman can provide information about this
- when your employment began and ended (if applicable)
- information about any long service leave you have taken
- details of any long service leave entitlement you were paid after your employment ended (if applicable).
About the employer
- business name
- contact details
- whether the business is still operating.
Supporting documents
- any documents that support your report, such as payslips, PAYG statements, emails or text messages.
If you want to remain anonymous, use our anonymous report form. However, if you are unable to provide information and documents or there is little prospect of our inspectors obtaining information and documents, we may be unable to proceed.
Update an existing report
If you have already made a long service leave report and need to supply additional documentation, you can update your report via our online form.
